Section 668 provides that proof that the act or neglect constituting the offence was committed by someone on board is sufficient proof that the ship has committed the offence.
The statute of limitations in respect of offences under Part XV is three years. (s.670).
Section 672 empowers a pollution prevention officer to detain a ship where he believes on reasonable grounds that an offence has been committed. The ship will remain under detention until satisfactory security up to the amount of the maximum fine is given. If no security is given, the ship can be sold.
