Notes:
The Transportation of Dangerous Goods Act gives the Crown a right of action to recover reasonable costs and expenses incurred to rectify a contravention of the Act or regulations. The liability of the defendant is presumed unless he/she proves to the contrary. Other persons are not given a cause of action under the Act but their existing causes of action are expressly preserved.
