Notes:

 

    The Transportation of Dangerous Goods Act imposes criminal liability for failure to comply with the Act. The maximum penalty is a fine of $50,000 for a first offence and $100,000 for a subsequent offence if the prosecution is by way of summary procedure. If the prosecution is by way of indictment, the maximum prison term is two years. Any officer, director, or agent of the corporation who authorized, assented to, acquiesced in or participated in the offence is a party to the offence.
    Liability under the Transportation of Dangerous Goods Act is not absolute. It is a defence to show that all reasonable measures were taken to comply with the Act or prevent the commission of the offence.
