Facinating site. As a private boat owner with a my vessel at a marina, I have signed a dock rental agreement which includes a waiver of liability.
My vessel is insured, but I am left wondering if my insurer will accept my waiving their right to subrogate in a claim involving the marina's negligence?

The following situation occurred while on a sailing trip. Motor died and could not be revived. Continued sailing but ended up completely becalmed. We were not in distress or immediate danger but accepted a tow rom a very friendly boater.
Questions are:
With no contract or verbal agreement what would the general liability be if they pursued the situation.
If I had been in distress or imminent danger would the liability change?
